Apple is facing a class action lawsuit for failing to pay weekly pay to New York State employees. Former Apple Store employee Raven Ramos, who worked at the Fifth Avenue store, is suing on behalf of herself and current employees in New York.

In New York State, the law requires companies to pay manual workers on a weekly basis. This refers to workers who “engaged or engaged in physical labor in the course of their employment.” However, a company may be authorized by the commissioner of the New York City Department of Labor to pay its employees semi-annually.

According to the class action lawsuit, at least 25% of Ramos’ job duties at the Apple Store involve manual labor. This includes “working on the sales floor, unpacking groceries, emptying cash registers, and assisting customers.” Apple’s failure to pay timely wages also caused Ramos to lose “the time value of that money.”

The document says that Apple does not have the right to pay every six months. The Cupertino-based company owns several stores in New York and employs more than a thousand employees. Ramos, a Port Chester, New York resident, worked at Apple from October 2010 to January 2018 and was paid semi-annually throughout that time.

The class-action lawsuit involves at least 100 employees and alleges that the total amount of each member’s claims “exceeds $5 million”.

The participants in the case expect to receive from Apple “the amount of untimely paid wages as liquidated damages.” It also asks for “reasonable attorneys’ fees and expenses, and interest before and after the award is made.”
