Ministry of Digital Development of Russia going introduce a moratorium on administrative liability for the sale of smartphones, tablets, computers, laptops and smart TVs that do not have domestic software pre-installed.
The ministry recalls that the government legalized the parallel import of goods due to the suspension of the activities of some foreign companies. Its essence lies in the fact that the supply of goods to the country bypasses the manufacturer and without the consent of the copyright holder.
However, Russian law requires manufacturers of equipment to pre-install domestic software, and if the order is not followed, the manufacturer and seller will be fined. Given the permission to import “gray” goods, a legal conflict arises.
The Ministry of Digital Development has already prepared a proposal to amend the Code of Administrative Offenses of the Russian Federation. Moreover, the changes will not affect equipment manufacturers, who are required to pre-install Russian software on their devices, as before.
